The Madras High Court has directed the Government Medical College, Theni, to treat a girl candidate as admitted student, who inadvertently selected a column to surrender her seat in a newly introduced online application system for medical admission.
S. Apsara, a first graduate from her family and resident of Palakkad district, Kerala, after successfully completing higher secondary education, had applied online for admission to M.B.B.S degree course 2015-16 under the All India Medical Quota.
In view of her meritorious performance in higher secondary examination, she was allotted a medical seat by the Directorate of Medical Education through a provisional allotment letter dated August 23, 2015. She was allotted a seat in the Government Medical College, Theni, which according to the petitioner was her 17th option.
On deciding to join the Theni college, she paid the entire tuition fees for the first year on August 26, which was accepted by the management. However, when she visited the college on September 6 to attend the course, she was informed by the management that she was not eligible to attend the course as she had opted to attend the second and third round of counselling.
On inquiry, she found that her younger sister had inadvertently pressed the surrender option in the website without the petitioner’s knowledge.
Wondering why the surrender option was still available even after admission to the Theni college by paying entire fee, she made representations to the Directorate of Medical Education, Chennai, and the Dean, Government Medical College, Theni, to restore the seat.
As her representation did not receive any positive result, Apsara approached the High Court.
Admitting the petition, Justice M.M. Sundresh made an interim order to the authorities to one seat vacant till the final disposal of the petition.
When the petition was taken back for hearing, counsel for the petitioner contended that the question of surrendering or exercising the option to surrender would come before the admission preceded by payment of fees. However, once the candidate has paid the fees, which was duly acknowledged by the college, there is no question of surrendering the seat, even if the candidate wants to, counsel said.
